We have been discussing this on creditslips too with KP posting the initial topic. <br /><br />If Lanning went the way of "Mechanical Approach" would Nowlin have been overruled? If not the 13 Trustee would have had it both ways right? I ask because the Trustees now require a confirmable plan with stepped up payments when they pay off 401k loans, vehicles..etc..at sometime in the distant or not too distant future... instead of a forcing a mod. <br /><br />What I posted on creditslips in part was that this op. actually brought back the BK Judges discretion or in other words he actually weighed the equities which in my opinion is what they are supposed to do and it was the right thing. I guess with this op congress did a poor job of abrogating that discretion (totally bad idea to do that in my humble opinion). <br /><br />Kaite Porter (love her, respect her) said that this would be a negative for debtors but I totally think its the opposite.Patchesnoreply@blogger.com
